A part of the work that I do is with clients who are having long running disputes with insurers over repairs and remediation to their property after an insured event. The cruel reality for some insureds is that they cannot live in their house or rent out an investment property for years because of claim delays.
Shuffling between staff, changes to an insurer’s preferred suppliers and the very nature of some insured events, are a few reasons why claims run longer than they should. Most insureds are more than patient with their insurer but people can only take so much.
Insureds can find communicating with a big insurer quite maddening. After extreme delays, many insureds believe that their insurer’s actions are deliberate tactics to pressure into accepting a lower settlement. These are not uncommon beliefs held by insureds. Insureds perceive what I would describe as incompetence or apathy as duress. Not a good look for an organisation.
Some insurance policies provide cover for professional fees or claim preparation costs. Such a term may extend to cover to the insured for the cost of a lawyer to assist with claims resolution. The intervention of an independent insurance lawyer can expedite the resolution of a claim which has stagnated.
